TERMS OF USE 

Welcome to the Program Design Solutions, Inc. Web site (the "Site"). By accessing this Site, you agree to be bound by the terms and conditions below (the "Terms"). If you do not agree to all of the Terms, please do not use the Site. Program Design Solutions, Inc. may from time to time modify or revise the Terms by updating this Web page. Your use of our Site following any such change constitutes your agreement to follow and be bound by the Terms as changed. If any change is unacceptable to you, your only recourse is to terminate your use of the Site.

PRIVACY 

It is our policy to respect the privacy of individuals who visit the Site or provide Comments to us. By accepting these Terms, you expressly consent to the use and disclosure of your personally identifiable and other information as described in the Privacy Policy.

ESTIMATES AND QUOTES 

When making general inquiries or seeking a range price for projects where there is not much or all of the details, we issue an estimate based on what is known.

 

If greater details change, augment or enhancement the project from the original concept, it constitutes a new project and requires a new estimate.

 

Once all details are set, we issue a quote for how much the final project will cost.

 

If the project begins and changes are still forthcoming, the original quote and preceding quotes are no longer valid. Program Design Solutions will issue a new quote to complete the work, at each new stage.

 

Payment for current work must be paid, before new work can begin.

 

If the client selects to cancel, based on the new quote, the client is responsible for all labor and materials utilized up to the point of cancellation.

 

Because of our global market and constantly reshaping economy, our price estimate and quotes are good for 14 days, "approved" final designs, based on the requirements given. Honoring prices beyond that time is solely at the discretion of Program Design Solutions. When it trends downward, we are more than happy to pass along the additional savings to you.

PERSONALIZATION 

Concerning certain items for engraving, etching, imprinting or embossing, at times, Program Design Solutions may find it necessary to substitute font type, size or face, or even adjust designated locations, based on the unique and dynamic needs and interactions of some artwork detail and the surface material of the selected product.

 

At such times, Program Design Solutions, Inc. will make every effort to stay within the spirit and artistic direction of the original request, and contact the requester, order originator or signatory to apprise the contracting party of such details.

Although we make every effort to follow all terms to the letter, Program Design Solutions, Inc. reserves the right to halt service or production on any item(s) it deems racially, sexually, socially, culturally or religiously inflammatory.

GRAPHIC DESIGN  

All or a portion of Graphic Designing and Set-Up are waved, where Program Design Solutions is also producing the product or selected to provide the service.

 

However, if the customer decides to not pursue production or service, the customer will incur the cost of design and development at the full rate, as if such services were intended to be stand alone deliverables.

HOLIDAY ORDERS

Please remember that during the holiday season, we will be extending our minimum turnaround time by two (2) business days (36-40 hours), if needed, due to the high volume.

 

Depending on volume, it may be longer.

 

Rush orders, accelerated processes and additional resources will incur potential added costs.

PAYMENT POLICY 

When applicable, Program Design Solutions will ship and deliver the invoice with your order.

Some services require an upfront retainer or deposit. All other payments are due upon delivery.

If the recipients fail to open, misplace, damage or destroy the invoice, that will not constitute nor imply an extension of the due date.

At 30+ days, the balance will incur monthly late fees ($35) and monthly penalties (10.97 APR), as outlined in a duplicate invoice and courtesy two-week reminder.

If you have sent in your payment prior to receiving the duplicate invoice, please disregard the reminder.

DEPOSITS  

Because we produce unique signature items for each client, there is little reuse for any branded products we produce with your company's name, logo and slogan.

 

Therefore, concerning raw materials that are novel to your project, we may require a deposit prior to commencing with the project.

 

Where a deposit is required, no work will begin until the receipt of funds.

 

Therefore, please be mindful of your project delivery timeline. Production time begins once we have the materials and funds.

SCHEDULING AND TIMELINES  

To keep your costs down, we schedule your projects to maximize efficiencies.

 

The turnaround time varies and will we will state the production time at approval of final design approval.

 

For standard printing, there is a minimum of 72 hours.

 

Rush orders may incur additional costs, based on time of day, off-hours production, cost of expediting materials, shipping, etc.

 

We will state this up front and terms must be approved prior to producing the items..

SERVICES & CONTRACTS  

Services and contracts will be administered by the terms of the agreement.

 

If a dispute should arise any party may seek arbitration. Addition of services or alteration(s) to the original contract(s) will constitute a new service agreement or contract.

 

As a result, pricing, time, materials, resources, effort, delivery, schedule and other items may be affected.

MISCELLANEOUS 

These Terms are governed by and shall be construed in accordance with the laws of the Ohio without giving effect to any principles of conflicts of law.

 

If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

 

These Terms are effective unless and until terminated by Program Design Solutions.
